NGOs Take Trump to Court Over Ban on Transgender People in the Military

Lambda Legal and the Human Rights Campaign Foundation (HRCF) have gone to court against the Trump administration's transphobic policy that prevents transgender peoples from serving in the United States military.

Trump and Exclusion: When Gender Identity Is Seen as an Obstacle to Competence and Dedication

On March 25, the NGOs presented their arguments to the U.S. District Court, seeking an immediate injunction to block this unjust and cruel measure. The ban, formalized by the Department of Defense in February, mandates the expulsion of transgender service members within 30 days. For Trump and his allies, we are deemed unworthy of wearing a uniform and fighting for the country, as if our gender identity is a greater obstacle than our dedication and competence.

But who really stands against the values of democracy?

Attorney Jennifer C. Pizer from Lambda Legal had already pointed out that this policy is illegal. "What the Trump administration is doing is unconstitutional. They want to turn the U.S. into a country where people give up their rights without a fight. But we will not allow that."

Kell Olson, another lawyer from the same organization, emphasized that this decision violates constitutional principles such as equal protection and freedom of expression. "These transgender soldiers are dedicated and highly skilled. They want to be judged by what they do, not by who they are. There is no logical military justification for this ban, only stereotypes and prejudices."

Sarah Warbelow, Vice President of HRC, aptly states: "The government has no real evidence to bar transgender people from the military, except pure prejudice."

We Will Not Be Silenced

The attempts to erase us are many, but we are here. We resist in the dark alleys where they tried to hide us, in the squares we've turned into homes, in the hearts we've won, and in the dreams we refuse to abandon. History shows that we are not going anywhere but toward the future we are building with our own hands.

And if you want to know: we, transgender and transvestite people, remain strong. Because fighting for our rights is to exist. And existing, for us, is already an act of revolution.

ONGs Enfrentam Trump na Justiça Contra Proibição de Pessoas Trans no Exército

 As organizações Lambda Legal e Human Rights Campaign Foundation (HRCF) entraram na Justiça contra a política transfóbica do governo Trump, que impede pessoas transgênras de servirem no exército dos Estados Unidos.

Trump e a Exclusão: Quando Identidade de Gênero é Visto Como Obstáculo à Competência e Dedicação

No dia 25 de março, as ONGs levaram seus argumentos ao Tribunal Distrital dos EUA, pedindo o bloqueio imediato dessa medida injusta e cruel. A proibição, formalizada pelo Departamento de Defesa em fevereiro, exige a expulsão de militares trans em um prazo de 30 dias. Para Trump e seus aliados, não somos dignas de vestir uma farda e lutar pelo país, como se nossa identidade de gênero fosse um obstáculo maior que nossa dedicação e competência.

Mas quem é mesmo que está contra os valores da democracia?

A advogada Jennifer C. Pizer, da Lambda Legal, já tinha alertado que essa política é ilegal. "O que a administração Trump está fazendo é inconstitucional. Eles querem transformar os EUA em um país onde as pessoas cedem seus direitos sem lutar. Mas nós não vamos permitir isso."

Kell Olson, advogado da mesma organização, reforça que essa decisão viola princípios constitucionais como a proteção igualitária e a liberdade de expressão. "Esses soldados trans são dedicados e altamente capacitados. Eles querem ser julgados pelo que fazem e não por quem são. Não há justificativa militar lógica para essa proibição, apenas estereótipos e preconceitos."

E Sarah Warbelow, vice-presidente da HRC, crava com precisão: "O governo não tem nenhuma evidência real para barrar pessoas trans do exército, a não ser o puro preconceito."

Não vamos nos calar

As tentativas de nos apagar são muitas, mas estamos aqui. Resistimos nos becos escuros onde tentaram nos esconder, nas praças que transformamos em lares, nos corações que conquistamos e nos sonhos que nos recusamos a abandonar. A história mostra que não vamos a lugar nenhum, a não ser em direção ao futuro que estamos construindo com nossas próprias mãos.

E se querem saber: nós, travestis e pessoas trans, seguimos firmes. Porque lutar pelos nossos direitos é existir. E existir, para nós, já é um ato de revolução.
